Cobell Appeal Hearing Set For May 15, 2012

The next hearing of an appeal in the $3.4 billion Cobell settlement case is set for 9:30 am on May 15th, 2012 in the Federal District Court for the District of Columbia Circuit. Circuit Judges Brown and Griffith and Senior Circuit Judge Ginsburg will be the panel that hears the oral arguments of the parties.

All appeals of the Cobell settlement must be resolved before any of the $3.4 billion can be paid out to the thousands of Native Americans across the country who are entitled to a share. The Court has not yet indicated when it will render its decision after the May 15th hearing, or if this decision will finally resolve the remaining claims that are holding up the payments.

Will interest be considered since it was approved 2011 and if not for appeal delays would have received back then.

Not only should interest be paid, it should be paid by the 5 people appealing. How about someone filing a class action suit against all 5 for the rest of us, asking for monetary restituion and/or removal from tribal rolls (that is if they are indeed natives)? Just a thought...

my issue withe the 5 people who appealed the settlement is why didn't they file their own lawsuit before the cobell class action began? if they felt that serious damages had ocurred to their iim accounts, it seems like they would have sought claims long before...i agree that alot of iim account holders were wronged in some fashion but we'll never get proper restitution so let's hope that the cobell settlement will be a lesson for 100% accountability & transparency in native american legal affairs & monetary issues.

When will every Native American realize there has never been any attempt to reimburse our ancestors and those of us still living with the magnitude of this payment called the Cobell settlement. It is not perfect, many people will receive a large payment, including the attorneys. But, if this is not received from the government at this time, many of us may never receive any compensation. I, myself, do not have the funds to hire attorneys to retrieve $1.00 as back payment. Yes, the five appealling individuals should have filed they lawsuit earlier,not when the funds are ready to flow to many. It's too late to be a hero. Ms. Cobell was the hero in leading the fight to get us this close to receiving payment. NOW, any individual blocking the payment is perceived as more of any enemy to our receiving payments. The government delayed long enough. Fellow Natives should not be part of the delaying game.

People ...read this ...yes of course ,out there is a lil trailer hovel or shambles in shannon county filled with barefoot n soiled stinky diapered lil indian ones trampling about flicking the flies away as their drunken mothers n missing fathers exhale the cigarettes and swig the booze ...as gas prices keep them home along with the much needed car repairs ...know this ...the few who are appealing and halting this funds dispersal are enjoying their POWERTRIPP ..and have zero care nor whim as to what they are doing ...chances are..they are represented by attention needing lawyers who are hoping to be able to BILL 5-600$PER HR for about 22HRS OF PAPERWORK ...AND IF there is a way to prevent frivolous outcryers who are abusing the system ..this should be looked into ...

This is to five people who's putting hold on the payment that is long past due to the indian people. Question ...WHY?!! Where were you when the cobell sisters were doing all the fighting with the gov't over all of this business. Were you there to lend a hand ? You should be greatful for what they did accomplished in there life time. Neither one of them got enjoy any of it and thanks to you five many more may not get to either. You should be ashamed of yourselves. It may not be so but it seems like you want to be greedy. Think of others ... some really need it.
